Young man arrested for battery of family member
Timothy Duran, 20, of Rio Rancho, was arrested for aggravated battery against a household member, battery against a household member, criminal damage to property of household member and interference with communications Oct. 19 at a residence on Pinnacle Drive.
Rio Rancho police received a report of domestic violence in which the caller said her sister’s son was “drunk and going crazy.” The sister told the caller that she might have broken ribs and had a hard time breathing.
The caller told police the victim came to the residence and Duran became extremely irate with them.
Duran, speaking to police outside the residence, said he and the victim were arguing when another man approached and struck him with a closed fist. As officers were speaking to Duran, one of them saw a woman mouth “help me” to them from the window of the residence. An officer went inside to see what the matter was.
Officers report that Duran was “all over the place and antsy at what officers were doing inside the residence” at this point.
The officer that went inside came outside and asked to speak with the other officer on scene. Just as this happened the caller came up to them and said that Duran hurt her sister badly, possibly breaking her ribs. Duran was immediately detained once they heard this.
Police entered the residence, which they reported was in disarray. They first spoke with Duran’s fiancé. Officers noticed she was “extremely scared and was hesitant to answer questions” because Duran could hear her. Officers ensured her that he could not.
She told police she and Duran’s mother arrived at the residence together and couldn’t get in because Duran had locked the dead bolt.
They were able to contact him by phone, but she said he was very irate with them. He opened the door and continued to be irate. She said he hit her with a closed fist and “tackled” his mom to the floor in the living room because she was attempting to call the police.
Police saw a mark on the fiancé’s cheek.
Duran said he couldn’t remember what happened. Then he said he and his mom got into an argument but denied that it got physical. Then he said his mom pushed him and he pushed her back. He said it never became physical between him and the fiancé. Then he said he did not remember anything else.
Police then talked to the mother. She was in her sister’s car and appeared to be in pain and said she was having trouble breathing.
She said when Duran pushed her, she collided with the couch and her ribs made contact with the arm rest. She said she felt them possibly crack or pop. She was transported to the nearest hospital.
Duran, if convicted, will face more than three years in prison.
