Woman also charged in Pena Blanca shooting
Complaint comes out nine days after cannabis store shooting
PENA BLANCA — More than a week after a cannabis shop owner was charged in a Pena Blanca shooting, a woman at the scene was also charged.
Colin Sandoval, 42, of Pena Blanca, was arrested Jan. 6 for aggravated assault, aggravated battery and negligent use of a deadly weapon.
Previous coverage of the incident reported that Sandoval allegedly injured a woman with a handgun after he and another woman confronted her and another man entering the store. The victim sustained an injury to the head and was taken to a hospital.
A new complaint, filed Jan. 15, summoned Tiffany Fragua, 25, of Pena Blanca — the other woman who helped Sandoval confront the couple — for aggravated battery tied to the incident.
According to a deputy narrative, the deputy was told the victim was subject to a gunshot wound to the back of the head and was being transported via helicopter to a hospital. She was treated for non-life-threatening injuries.
Sandoval was reported to be in custody. Two others believed to be witnesses were on scene, which was considered active. One of them was the victim's boyfriend and the other was Fragua.
The deputy got a warrant to check out the video surveillance from the shop and wasn't able to view the footage until Jan. 12.
In the video, Fragua was managing the business as the victim entered the shop and began speaking with her. A minute later, Sandoval is seen entering the store, instructing the victim to "get out" several times before pulling her by her backpack toward the door. The victim fell to the ground. Police note she did not seem to be combative in the video.
The victim's boyfriend then entered the business as the victim was being dragged on the floor by Sandoval. The man appeared to enter the structure with his hands inside of his pockets and was believed to be heard saying "put your hands up." He and Sandoval began a physical altercation, which continued outside.
Fragua and the victim continued to argue inside. In the video, Fragua is seen attempting to use her body and arms to press down on the victim to push her toward the door as she instructed her to get out. Police mention that it looked like the victim tried to strike Fragua.
Then, the victim's boyfriend went back into the store and told the victim they should leave the store because "he (Sandoval) has a gun."
The victim was heard stating "you got a (expletive) knife, right?" as she appeared to manipulate the pockets of his camouflage jacket, although it didn't look like he was holding a knife. The previous report found he was unarmed.
Fragua and the victim continued to argue, and Fragua pushed her to the ground again.
Fragua then disappeared behind the counter and came back holding a metal baseball bat. She told the victim to leave the store again. As the victim started to leave with her back turned to Fragua, Fragua hit her with the bat.
They started fighting each other, and Fragua repeatedly hit the victim with the bat.
Sandoval attempted to intervene with the black handgun in his hand.
Sandoval then hit the victim with the gun, which discharged a round, striking the victim in the back of the neck.
Sandoval could face about 4 1/2 years and Fragua could face three years in prison if they are convicted.
At this time, Fragua's summons has not been answered and Sandoval was released pre-trial.
