Teens charged with murdering a woman will stay in custody
ALBUQUERQUE — Three of the five teenagers accused in the killing of 35-year-old Marlene Gutierrez will remain in custody until trial, according to Bernalillo County District Attorney Sam Bregman.
Bregman did not say which of the teens would remain in custody but did say two 16-year-olds and a 17-year-old “will stay in custody after being charged in the fatal shooting of Marlene Gutierrez,” he wrote in a news release.
Terrance Morris, 17; Ean Spencer, 16; Jeffrey Moore, 16; Victoria Belmudez-Candelaria, 16, were arrested by Albuquerque police on July 3. The fifth teen, Jazelle Dudley, 17, is still wanted by police. All but Moore are from Rio Rancho.
All five face charges, including an open count of murder, attempted armed robbery, aggravated assault with a deadly weapon, conspiracy to commit armed robbery, tampering with evidence and unlawful possession of a handgun.
According to police, the group was driving around Albuquerque early June 10 when they ran low on gas. A witness told investigators that three of the teens decided to rob homeless individuals to get money for fuel.
The teens stopped in an alley near the 9200 block of Central Avenue NE, where Morris and Spencer allegedly got out of the car armed with handguns, police said.
“They approached people in the alley and demanded money,” APD wrote in a news release. The teens reportedly said “empty your pockets, we’re going to rob your asses,” police wrote in a news release.
A witness in a nearby travel trailer fired gunshots at Morris and Spencer, who returned fire before retreating. During the gunfire exchange, 35-year-old Marlene Gutierrez was struck by one of the bullets, APD said.
Morris returned and fire two more shots before the group fled the scene in their vehicle, police said.
