A Rio Rancho man is facing voyeurism charges after allegedly spying to two teens in a changing room at Target on Crestview Drive.

Jacob Garduño, 22, was summoned on two counts of the charge Jan. 19, when two teenaged girls reported that a male employee of the store was placing a phone under the door of the changing room and taking pictures of them. The girls told responding officers that they were shopping in the swimsuit section of Target, saw the man across the aisle and “got a bad vibe from him,” according to the police report. After shopping, they said they went to change in the changing rooms and lost sight of where the man had gone.

One of the victims said she was about to change when she saw someone put a phone under her door and take photos of her. She saw the hand go away, so she opened the door and saw the man kneeling in front of her friend’s door doing the same thing. Shortly after, he left the changing room.

The first girl said she was fully clothed, but the second one was in a state of undress when the man started taking pictures. They reported the incident to the attendant.

Officers confirmed the incident via surveillance footage, and the store manager confirmed the suspect, identified as Garduño, was a Target employee. They detained Garduño, who refused to speak to police without a lawyer present. His cellphone was confiscated as part of the investigation.

Voyeurism — the act of watching people undress, taking photos while they are in a state of undress and getting aroused by the person who is undressed — is a federal crime. Garduño, if convicted, will face two years in federal prison.
