Repeat offender charged with probation violation after ax incident
By getting arrested and charged in a Feb. 11 ax incident, Andrew Rivas III, 37, of Bernalillo, allegedly violated his probation from an arrest in November.
The violation report states that Rivas was placed on probation for three years Feb. 5 for aggravated assault on a peace officer with a deadly weapon and battery of a peace officer. The report notes that he was arrested for similar charges within six days of being placed on probation. “This time probationer Rivas was trying to break into one residence and later made entry into another residence with juvenile occupants. Probationer Rivas caused serious fear for the occupants and destroyed the residence in an attempt to flee from law enforcement. Probationer Rivas seems to be a danger to local law enforcement and also the public,” it reads.
Rivas violated three of the requirements placed on him: violating a law, possession of a deadly weapon (the ax) and failing to report the arrest to the probation/parole officer.
Rivas’s probation was revoked Feb. 15 and an arrest warrant issued. He is to be held without bond before trial.
Rivas has been in more than a dozen cases just in the past couple of years.
A probation violation can get an offender up to six years in prison.
