Andrew Apodaca, 28, of Rio Rancho, was arrested July 28 for aggravated DWI/DUI (refused testing), shooting at or from a motor vehicle and two counts of negligent use of a deadly weapon at the Local Brewhouse.

Witnesses and employees told officers a man got into an argument with another person at the brewery, which went outside. They said the man, identified as Apodaca, brandished a gun from the vehicle, charged it and put it in his belt line. He reportedly never pointed the gun directly at anyone. Officers found Apodaca in his truck near Cherry Road.

He admitted to firing the gun out the driver's side window. He also admitted to drinking several alcoholic beverages that day.

If he is convicted, he could face up to three years in prison.
