Police arrest man after struggle for gun aimed at them

James Colbert, 39, of Albuquerque, was arrested June 27 for two counts of aggravated assault and negligent use of a deadly weapon near the intersection of Nicklaus Drive and Slice Court.
While police were investigating an intoxicated driver, the passenger, identified as Colbert, was cited for seat belt violation and asked to exit the vehicle for it towed. When asked if he had a weapon, he responded "yes" and reached down to grab a gun from his left leg, arming himself despite instruction not to grab it. Officers note at this point Colbert acted threatening with the weapon, so an officer grabbed the barrel to take the gun away, resulting in the muzzle being pointed at other officers at the scene. The gun was ultimately taken from Colbert.
He later admitted to being impaired by marijuana.
If he is convicted, Colbert could face six or more years in prison.
