Manuel Gutierrez, 29, of Albuquerque, was arrested June 15 for two counts of aggravated assault with a deadly weapon, shooting at or from a motor vehicle, criminal damage to property and negligent use of a deadly weapon at a redacted address in Rio Rancho.
Multiple callers reported gun shots, and a man was seen shooting at a car, which left the area moments later. Witnesses said he had a gun and was chasing someone. Responding officers found multiple casings at the scene.
As officers were arriving, the victims called and said they were driving to Sandoval Regional Medical Center, as one thought she had been struck by a bullet during the shooting. The victims told police they had gotten into an argument with some people about a parking space, which lead to them shooting the victim's vehicle. They said the suspect who shot at them was the boyfriend of a neighbor and described him as a darker-skinned male with a goatee.
Other callers reported seeing two males run into an apartment a short time after the gunshots. Officers located the neighbor's car and an additional casing in the parking lot in front of their apartment. When officers made an order for people to exit the apartment, several complied, including Gutierrez, who fit the description of the suspect. He also had an outstanding warrant.
Gutierrez could serve at least 7 1/2 years in prison if he is convicted.
