Nevada man facing criminal charges for sexual contact of a minor

According to a criminal complaint filed by the Sandoval County Magistrate Court, a Nevada man was arrested March 28 and cited with two counts of indecent exposure, two counts of enticement of a child, two counts of sexual exploitation of children by prostitution, two counts of criminal sexual contact of a minor in the fourth degree and two counts of contributing to the delinquency of a minor. The victims are reported as under 18 years old.

Bernalillo police were called to an incident near Walgreens on US 550. Officers chased down and apprehended a suspect later identified as Anthony Garcia, 40, of Las Vegas, Nevada. The detective on scene reported in the criminal complaint that there were two boxes of condoms on the ground as well as a receipt. He also saw more sex products, some papers, a backpack and a wallet on a patrol unit. These were all placed into evidence.

The detective then met up with the two victims and one of their moms at McDonald’s. One of the victims reported that the two victims were friends. They told the detective that Garcia approached them and asked if they had anything to smoke. When the victim said no, Garcia asked them if they wanted to go into the McDonald’s bathroom to go smoke. Garcia was able to entice one of the victims to go into the bathroom. The victim reported that they didn’t want to go into the bathroom and “looked at their friend with fear.”

In the bathroom stall, Garcia asked the victim how old she is, revealing that she is a minor, and he then stated that he is 40 years old. The other victim then asked to go with them into the stall. The victim told the detective that “he was trying to pimp them out” by telling them that he would give them a million dollars if they would go to his house and “hook up” with him.

He began to make unwanted physical contact with both victims. He then pulled out a lighter and a pipe, said he was going to “smoke this real quick” and that he had THC. Then, he told the victims to make out with each other. When one victim stated her mom was texting them Garcia exposed himself and asked the victims to perform sexual acts.

That is when both victims left the McDonald’s.

The mom was driving towards the McDonald’s so they started heading back but they saw Garcia again. Then, police were contacted.

Garcia told the court March 29 that he was confused and angry. He also said he did not know what was going on. He started talking about other cases in other states and asked for a plea deal. He was reportedly confused and annoyed that he was in custody.

If he is found guilty, he could face up to 15 years for exploitation, two years for criminal sexual contact, two years for contributing to the delinquency of a minor, one year for indecent exposure and one year for enticement. If found guilty on all charges, that could add up to 21 years or more.
