May trial set for man now facing an attempted murder charge in armed robbery case
A man charged and indicted in an armed robbery case last year is now facing an attempted murder charge, and his trial has been set for May.
Tyler Stivers, about 24, of Rio Rancho was arrested Oct. 14 for armed robbery, aggravated assault with a deadly weapon, shooting at an occupied building and aggravated DWI/DUI which resulted in negligent use of a deadly weapon at Allsup's near Albertsons on NM 528.
At the time, Stivers allegedly went into the Allsup’s with a gun and took cash out of the register, then fired a shot into the store.
Stivers was arraigned for the additional charge of attempted murder in November and was detained pre-trial.
After his final docket call April 11, Stivers' trial is set to begin May 7.
With the added charge, Stivers could be sentenced to as much as 36 years in prison if he is found guilty.
