Man summoned for pulling out shotgun at Allsup's in Bernalillo
Joshua Vigil, 52, of Bernalillo, was summoned for aggravated assault with a deadly weapon and tampering with evidence at Allsup's on Camino del Pueblo in Bernalillo.
Bernalillo police officers responded to a report of a man pulling a shotgun on another individual with the caller, saying that as they were walking to the vehicle to tell the driver they were closed, the driver pulled out a shotgun.
The caller — an employee of the store — provided police with a photo of the license plate, which came back registered to Vigil.
When recalling the encounter, the employee told police he made it clear to Vigil that he would call police. He said Vigil then lowered the shotgun and tried to apologize. The caller then said, "he pulled a fast one on me" and that he wanted to press charges.
A short time later, the vehicle was pulled over by Sandoval County Sheriff's deputies. Vigil told officers he went to the Allsups to go to the Amazon drop-off when a guy came around the corner waving his arms and yelling at him. He said he put the gun on his lap so the man could see it. He said he knew the employee was going to call police, so he drove home and put the gun in his shed. He claimed he never aimed it at the employee but agreed it could be perceived as him pointing it at him.
Police took possession of the gun and let Vigil go but summoned him for the crime.
Vigil will serve at least three years in prison if convicted.
