Man summoned for battery after spitting on woman

Garth Garcia, about 23, of Rio Rancho, was summoned for battery charges after spitting on a woman June 24.

The incident stemmed from the report of an accident at the Wendy’s on Unser Blvd. The victim and a witness said that Garcia got out o his vehicle after the accident and yelled at the woman, allegedly spitting on her. The victim added that Garcia said, in a threatening way, that he was going to call his friends. She said she suggested he call the police instead, which is when Garcia spat on her.

Garcia admitted to he and the victim yelling at each other but denied spitting on her.

However, video of the incident matched the story of the victim and witness, and Garcia was summoned on the charge.

He could serve six months if convicted.
