Man arrested in gun incident at O'Reilly's

Sloane Vogel, 43, of Rio Rancho, was arrested July 16 for aggravated assault with a deadly weapon at O'Reilly's Auto Parts on Southern Boulevard.

Employees at the store reported that a homeless man was being chased by another man with a gun. They said they saw a laser pointed into the store as another man ran in saying he was being chased by a man with a gun. The suspected gunman was described as driving a gray truck.

Police found the truck and stopped it in front of the business. The driver, identified as Vogel, said he was going to a nearby bar and as he exited his truck a homeless man began to yell at him. They got into an argument when another man began to threaten him. He said the man grabbed a bottle and broke it to use as a weapon. He said the man went after him before he left to O'Reilly's. Vogel said the man left to call the police.

When police talked to the man, he said Vogel began to yell at him while he was sitting at the bar and threatened to kill him. He said Vogel threatened to shoot him and told him he had five minutes to leave. He said he was walking to O'Reilly's when Vogel pulled up next to him and pointed a gun at him. He said he grabbed a bottle and broke it to defend himself. He looked back at Vogel and saw he was still pointing the gun so he ran toward the auto store.

Vogel vaguely admitted to having a gun in his truck but denied officers permission to search the vehicle.

Vogel could face a year and a half in prison if he is convicted.
