Man arrested for the fifth time in Rio Rancho

Kenneth Wolfe, about 36, of Albuquerque, was arrested on Christmas Eve for aggravated DWI/DUI, two counts of battery upon a peace officer and resisting, evading or obstructing an officer.
Wolfe was previously arrested on four separate occasions in December, October, September and August.
This time, officers were dispatched to the intersection of Unser and Southern boulevards in response to a report of a man passed out behind the wheel in the middle of the intersection and saw the man, identified as Wolfe, slumped over the wheel of the SUV he was driving.
The vehicle was in gear with the engine on. Rio Rancho Fire Rescue then assisted in putting bricks under the tires to keep it from moving anywhere. They were able to get the door unlocked.
Wolfe was ordered to exit the vehicle, and officers said they could immediately smell alcohol on his breath. When Wolfe got out of the vehicle, he stumbled and had to use his hands for balance. Wolfe was then asked to participate in standard field sobriety tests but he declined.
Officers report that Wolfe did not know where he was at and told officers he was “in the driveway of an intersection.”
While trying to put him in custody, officers wrote that he was resisting passively and actively resisting by not wanting to get in the vehicle and proceeded to actively resist. While officers attempted to escort him into a vehicle, he kicked one officer in the thigh and wrapped his legs around another officer’s leg, applying pressure, while making “homicidal statements.”
Officers transported him to the Rio Rancho Police Department, where he still refused to give a breath sample.
Wolfe was released prior to his hearing on the conditions that he not drink, drive, do drugs or leave the county.
Wolfe, if convicted, will face up to four years in prison.
