Man arrested for pointing gun at driver at Havasu Falls Park

Rio Rancho police officers arrested Daniel Rogers, around 34, of Rio Rancho, for aggravated assault with a deadly weapon on May 1 at Havasu Falls Park.

According to the criminal complaint report filed by RRPD, officers responded to a call about an armed subject near the park. The caller said Rogers came toward his vehicle armed with a gun and pointed it at his face. He then saw Rogers get into his pickup truck and park in the parking lot of the park.

When officers talked to Rogers at the scene, he admitted that he got into a verbal disagreement with the victim, who was driving at a high rate of speed. Rogers told police that he yelled at the victim to slow down. The victim reversed toward Rogers and confronted him about what he had shouted.

Rogers then walked up to the passenger window and told him to slow down. Rogers stated that at no point did he present a weapon nor have one in his vehicle.

Officers also talked to a bystander, who stated that an altercation took place between the victim and Rogers in the intersection near the park. The bystander said that as they were sitting in the passenger seat filling out paperwork, they heard Rogers yell at the victim to slow down. They saw Rogers exit the vehicle for a brief moment to make contact with the victim and saw Rogers put a handgun in the center console when he returned to his vehicle.

The victim stated that he stopped in the intersection after hearing Rogers yell at him. He had stopped in the intersection and reversed his car to speak with Rogers. He said Rogers approached his passenger window, leaned on the door and pointed a handgun in his face. Rogers proceeded to tell him to slow down and walked away toward his truck.

If convicted for the aggravated assault with a deadly weapon charge, Rogers faces 18 months and a $5,000 fine.
