Tyler Stivers, about 24, of Rio Rancho was arrested for armed robbery, aggravated assault with a deadly weapon, shooting at an occupied building and aggravated DWI/DUI which resulted in negligent use of a deadly weapon Oct. 14.

Officers responded to the Allsup’s on Ridgecrest Drive at 1:47 a.m. on a call of an armed robbery. Callers said that a man had gone into the Allsup’s with a gun and taken cash out of the register, and then fired a shot into the store and left in a dark-colored Cherokee Jeep. One clerk said he saw Stivers standing in the store with a rifle and demanded money from the register, and he complied. Stivers then left, and the clerk heard a shot go through the window, prompting him to take cover. The supervisor confirmed the clerk’s story.

Officers were able to find the Jeep, driven by Stivers, heading west on Northern Blvd., and the vehicle was stopped in front of Lowe’s. They found cash on him, and he was taken into custody.

Officers also noticed that Stivers had the smell of alcohol on his breath and asked if he had anything to drink. He said he did earlier in the day. They also found a rifle in the jeep and took Stivers to Allsup’s, where the employees positively identified him as the robber.

Stivers, if convicted, will face 21 or more years in prison.
