A man was detained by SWAT in a domestic incident after he refused to leave the residence.

Eric Robertson, 59, of Rio Rancho, was arrested March 25 for aggravated battery against a household member on Autumn Meadows Drive.

The therapist of the victim called police with concerns because Robertson called and cancelled the appointment the victim had that day. Police did a welfare check the day before the incident, but no one answered the door.

At the request of the therapist, police went back March 25 for another check. This time the victim answered the door appeared to be injured and was transported to a hospital.

The victim sustained serious injuries to an eye and head from an altercation with Robertson. There had been previous domestic incidents when Robertson was transported for making suicidal threats and at one time accused the victim of cheating on him.

However, this time Robertson physically assaulter her, continuing off and on until police arrived. While the victim left with police, he stayed behind in the home.

Rio Rancho SWAT was called in and spent several hours attempting to get Robertson out of the home. Eventually he complied and was taken into custody.

If he is found guilty, Robertson will serve three years in prison and pay a $5,000 fine.
