Colt Dalton, 39, of Albuquerque, was summoned April 19 for residential burglary, unlawful taking of a motor vehicle and criminal solicitation at a residence in Corrales.

The victim contacted Corrales police April 14 stating Rio Rancho Police let her know her car was recovered and towed to a local yard. In the Rio Rancho report, it states the suspect Ashley Garcia was caught driving the car, who told arresting officers the car was her boyfriend's, Conrad Cunes, who had been recently arrested.

Cunes was at Bernalillo County Detention Center for a probation violation related to aggravated burglary and armed robbery charges. He told Corrales Police that he got the car from Dalton. He said Dalton told him that he and his mother inherited the car from a man his mom was taking care of.

Dalton was also incarcerated at Bernalillo County Detention Center as well. He repeated what Cunes said but added that the victim is the sister of the deceased person his mom was taking care of. He said his mom and the victim had some kind of falling out before the man died and his mom stopped taking care of him. Dalton said when he found out the man died he asked a friend named "Sergio" pick up the car for him but that "Sergio" never brought the car to him. He said he was going to give the car to his mom as a surprise.

Police confirmed that all of the deceased man's property, including the car, belonged to the victim and summoned Dalton.

Dalton could spend four years in prison if he is convicted of the new charges.
