Frederick Whitaker III, 54, who was convicted on dozens of sexual assault charges in 2008, is facing new charges out of Florida.
On Dec. 18 and Jan. 29, the 13th Judicial District Court heard evidence from Florida police that Whitaker violated probation by committing more crimes in Volusia County, Florida.
The Rio Rancho man was arrested in 2008 for 55 counts of sexual exploitation of children, eight counts of criminal sexual contact with a minor, two counts of kidnapping and one count of criminal sexual penetration of a minor in Sandoval County. He was convicted of them all and sentenced to 33 years in prison and five to 20 years of probation.
According to a report filed with the New Mexico Department of Corrections, Whitaker was arrested Nov. 22, 2022, and charged with 11 counts of failure to register. He had a second cellphone registered with a fake name and address as well as numerous web page, email and application aliases.
After police investigated further, he was charged with contributing to the delinquency of a minor; use of a computer to seduce, solicit or lure a child; illegal use of a two-way communication device; and 50 counts of possession of photos (sexual performance by a child). He was also allegedly using Discord to communicate with several young children around the world. He had solicited sexual content from them and had shipped a sex toy to a young girl in Texas.
The report says he had been doing this on Discord, Instagram, Snapchat and other platforms with fake names since February 2022.
Police also found that Whitaker had a cloud storage application called MEGA, which is a New Zealand-based company. On the application, they found 50 saved photos and videos of child pornography. Victims, both male and female, were ages 9 and under. They found more videos depicting sexual abuse material on a second phone as well as several naked photos of Whitaker that were sent to underage children, including a middle schooler.
Whitaker also filed his address as the Volusia County Jail. Florida police filed a bench warrant after the investigation.
