The city of Rio Rancho prohibits fireworks that go higher than 10 feet and are louder than a cap gun.

“For a number of years, the city of Rio Rancho has had its ban in place regarding all of the types of fireworks it can legally prohibit under state statute. The only changes to state law would give the city of Rio Rancho authority to ban the sale and use of currently legal fireworks in the community,” the website states.

The city also says citizens should be cautious that purchasing fireworks from a vendor does not always mean that they are legal for use within city limits.

They recommend looking for the “Safe and Sane” label when purchasing fireworks as these do not fly or explode. If you purchase fireworks in the city of Rio Rancho, the Fire and Rescue Department has inspected and approved all fireworks vendors to assure that the “Safe and Sane” criteria has been met.

City representatives shall seize, take all stocks of non-complying fireworks offered or exposed for sale, stored or held in violation of city ordinance — at the owner’s expense.

Any person that is issued a citation and found guilty of selling, being in possession of or using a firework within city limits in violation of city ordinance will be fined not more than $500 or imprisoned for a period of not more than 90 days, or both. Each instance of violation of city ordinance shall constitute a separate offense.

Igniting fireworks, starting or maintaining any fire, or smoking in the Rio Rancho Bosque is prohibited by city ordinances at all times. Those found in violation of these restrictions can face a fine up to $500, 90 days of jail time, or both.

If anyone believes illegal fireworks are being sold or used in Rio Rancho, call the public safety non-emergency telephone number, 505-891-7226.
