Notice of Request to modify the City of Rio Rancho

Sewerage System

Pretreatment Program.

The EPA previously approved a Pretreatment Program that was required by the General Pretreatment Regulations (40 CFR 403) for the City of Rio Rancho. Requirements to implement the approved Pretreatment Program have been incorporated in NPDES Permit No. NM0027987 issued to the City of Rio Rancho.

The applicant has submitted a request for approval to modify its Pretreatment Program as follows:

Changes made to the ordinance, and redevelopment of technically based local limits for pollutant discharges to the City of Rio Rancho Sewerage System.

A determination by the EPA to approve the request to modify the Pretreatment Program will result in the EPA modifying the applicant’s NPDES Permit as appropriate to ensure compliance with the changes.

Public comments on the proposed program should be submitted, in writing, within thirty (30) days, either in person or by mail, to the above EPA address. All written comments will be considered in the decision to approve the program modification. If no substantive comments to this notice are received, the proposed Pretreatment Program modification will be approved as set forth herein and shall be incorporated in the NPDES permit without changes and without further public notice.

In such event, this notice shall constitute the "notice of approval required by 403.11(e) and notice of incorporation in the NPDES permit in accordance with 40 CFR 122.63(g)." No additional notice shall be provided. Anyone who wishes to be sent notification of the approval of the modifications should send a request for such notice to Ms. Evelyn Rosborough at the above EPA address. A copy of the final permit decision will be transmitted to the permittee following the thirty (30) day comment period.
