Wayne Shively, 67, of Rio Rancho, was arrested at around 9:30 p.m. Aug. 6 in the 6900 block of Concord Hills Loop for two counts of aggravated assault against a household member with a deadly weapon and battery against a household member.

According to a criminal complaint filed in the 13th Judicial District Court in Sandoval County, officers responding to a domestic violence report found five people standing at the intersection of Concord Hills Loop and Bismark Hills Way. They said the family was having dinner and drinks around 6 p.m. when Shively became belligerent and started to argue with his family because he did not like the way they were talking to each other. He told everyone to leave his house. He pushed one of the family members, and another told him to stop. The family thought it was best to leave Shively in the house and left.

The family came back around 9 p.m. When two of them entered the house through the garage, Shively was armed with a shotgun and pointed it at them. They immediately left the house and called police.

Shively is being held at the Sandoval County Detention Center and faces up to four years in prison if he is convicted.
