NOTICE is hereby given that on September 26, 2018, Kay Bielman and Gregory Bielman, 3269 Hwy. 485, Jemez Pueblo, NM 87024, filed Application No. RG-43286-1 POD2 with the STATE ENGINEER for Permit to Change Point of Diversion of Groundwater within the Rio Grande Underground Water Basin, in the State of New Mexico. The applicants propose to discontinue the use of 3.0 acre-foot per annum of groundwater from existing declared well RG-43286-1, for domestic or livestock purposes, described as located within the projected SW1/4 NW1/4 NW1/4 of Section 17, Township 17 North, Range 2 East, NMPM, within the Canon de San Diego Grant, at a point originally described as X=349,220 feet and Y=1,713,260 feet, NMSPCS, NAD27, Central Zone, within Tract 5, on Map No. 11 of the Rio Jemez Hydrographic Survey, within Sandoval County, New Mexico, on land owned by Kay Bielman and Gregory Bielman. The applicants further propose to drill and commence use of a replacement well RG-43286-1 POD2, completed with a 2-inch casing, to a depth of 40 feet, located within 20 feet from said existing well, at a point descirbed as 35° 42' 29.10" North Latitude and 106° 45' 30.63" West Longitude, WGS84, within Sandoval County, New Mexico, on land owned by the applicants. The existing well, RG-43286-1 will be plugged. The wells and the place of use are generally located at 3269 Hwy. 485 (Gilman Area), Jemez Pueblo, NM, approximately 7.7 miles north of Jemez Pueblo, Sandoval County, New Mexico. This application is made to replace existing declared well RG-43286-1 (Rio Jemez Adjudication), which has collapsed and needs to be replaced. Total diversion of water from the replacement well will not exceed 3.0 acre-feet per annum for domestic or livestock purposes. No new appropriation of water is requested by this application. The applicants requested and have been granted an Emergency Authorization to drill and commence use of the replacement well within 100 feet of the existing well under Section 72-12-22, NMSA, 1978, Underground Waters stating that an emergency situation exist in which the delay caused by publication and hearing would result in extreme hardship as original well RG-43286-1 has collapsed and water is needed immediately for domestic and livestock purposes. Any person, firm or corporation or other entity having standing to file objection or protests shall do so in witing (objection must be legible, signed, and include the writer's complete name, phone number, and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, within ten (10) days after the date of the last publication of this Notice. Fascimiles (faxes) will be accepted as a valid protest as long as the hard copy is hand-delivered or mailed and postmarked within 24 hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4060.
